A day before that, plaintiff attempted to enter his residence but could not because his landlord changed the locks. When he called 911, police arrived and indicated that plaintiff had been unlawfully evicted and could either lawfully enter and break into his residence on his own or employ a locksmith to lawfully enter his residence. On the day of the incident, Plaintiff was lawfully present with a locksmith attempting to lawfully enter his residence. Defendants then arrived and unlawfully approached Plaintiff then falsely accused him of a criminal offense to which the plaintiff responded that police officers the day before advised him that he was unlawfully evicted. Defendants continued to falsely accuse Plaintiff of a criminal offense and illegally searched Plaintiff's person. Defendants violently contorted Plaintiff's arms behind his back to affix metal handcuffs to Plaintiff's wrists in an excessively tightened fashion. Defendants then placed Plaintiff in a police vehicle and transported him against his will to the 73rd Precinct, where Plaintiff was denied medical attention, and illegally detained for approximately eight (8) hours before being transported to Central Booking where he was again illegally detained for approximately twenty-one (21) hours before being released from physical custody after their arraignment.
