Neither Plaintiff was home during the search. Only Plaintiff wife's mother, their 1 1/2 year old son, and niece and nephew were in the apartment during the search. The officers were looking for Plaintiff husband and asked where he kept his gun. No one in the apartment kept a gun. Officers left the apartment but returned the next day and illegally seized and searched Plaintiff wife's phone and used it to call numbers stored on the phone. Officers then told Plaintiff wife she needed to go with them to the precinct. At the precinct, officers told Plaintiff wife that if she did not falsely testify that Plaintiff husband had used her phone earlier in the day in connection with a robbery she would be arrested. Plaintiff wife refused to lie and was arrested without cause. Plaintiff was released from custody the next day and the District Attorney declined to prosecute her, but her phone was never returned. When Plaintiff husband had heard of his wife's arrest he went to the precinct. He was questioned about his activities the day before and signed the statement. After he signed the statement, Officer Gutierrez continued to write on the paper at Plaintiff husband's objection.
