Two plainclothes John Doe members of the NYPD (on information and belief two of Defendants Miller, Urena, and Burkhard) approached Plaintiff’s car with their weapons drawn and told Plaintiff to put her hands up, which she did. The two John Does told her to get out of the car, which she did. At this point, Plaintiff informed them that she is a NY state corrections officer. The John Does then handcuffed plaintiff behind her back. The handcuffs were applied with painful and punitive tightness. These officers also handcuffed plaintiff's acquaintance who was in the car with her. The officers then searched the car, including internal compartments and under the seat, without cause or justification. The officers then asked plaintiff to provide ID, which she did: she gave her wallet, which had her badge, correction's officer ID, and driver's license. Approximately 5 or 6 other uniformed officers (one of whom was female) arrived. The female officer patted down plaintiff. \n\nPrior to being removed from the scene the two plainclothes JOHN DOES told\nPlaintiff, in sum and substance, that they did not have anything on Plaintiff (i.e., that they had no evidence that Plaintiff had committed any crime), and that they were just going to take Plaintiff to a police precinct and let Plaintiff go from there. A sargeant (Burckhard) was at the scene as well. When the two plainclothes JOHN DOES told the Sergeant that Plaintiff was a Corrections Officer and that they had not found anything illegal in her car, the Sergeant\nresponded, in sum and substance, that Plaintiff had to be arrested as well. Plaintiff was then placed in a police van and held there for approx. 30 min. The van was extremely hot due to no air conditioning. Plaintiff was then driven around for about 2 hours. Plaintiff complained that the handcuffs were causing her pain, and that she had to go to the bathroom, and that she was having difficulty breathing, but her complaints were ignored by the two plainclothes John Does who had arrested her, who were transporting her in the van. Plaintiff was brought to the 44th Precinct. She was held at the precinct for a couple of hours and then brought to Bronx Central Booking. She was arraigned the following evening. Defendant Urena was the deponent of the criminal complaint that alleged Plaintiff sold controlled substances. The complaint made numerous false allegations about drug-related interactions the undercover officers had with plaintiff.
