Defendant Checo, along with defendant NYPD officers Moises Garcia (Shield No. 5782) and Thomas Warkenthien (Shield No. 3876) then chased plaintiff down the street. Defendant Checo then exited his vehicle and drew his gun on plaintiff, noting that he would shoot plaintiff to stop him. Defendants Checo, Garcia and Wakenthien then tackled plaintiff to the ground, punched him, kicked him, beat him and handcuffed him. One of these three defendants put his knee on the top side of plaintiff's face, pressing it into the ground. Plaintiff was taken to a local precinct and processed, and was denied medical care by defendant NYPD sergeant Stephen Monroe (Shield No, 2330). Plaintiff was eventually taken to a hospital. Plaintiff suffered severe injuries as a result of this incident. Defendants proceeded to maliciously prosecute plaintiff despite knowledge that he had committed no crime.
