Because of the arrest, the court issued a protective order precluding Plaintiff from having contact with his minor daughter. The charges brought against Plaintiff related to April 12 were dismissed on May 9, 2019, causing the order of protection to be vacated.  On July 23, 2019, the Queens Family Court issued an order returning custody of Plaintiff's daughter to Plaintiff. When Plaintiff attempted to retrieve his daughter from her mother's home on August 9, 2019, Plaintiff's mother refused to release her as required by the order. Then, Plaintiff called for police assistance.  When Defendant Officer Zaverukha (and John Does 1-3) arrived, he accused Plaintiff of violating the original protective order. Plaintiff produced a \"raised seal\" Court issued disposition proving the April 12, 2019 arrest had been dismissed and the order of protection vacated. Despite this, Defendant Officer Zaverukha placed Plaintiff under arrest for alleged violation of the order of protection. Plaintiff was taken to a police precinct and eventually to Kings Central Bookings to await arraignment. Defendant Zaverukha prepared arrest paperwork and coordinated with the DA's office regarding (malicious) prosecution for criminal contempt (second).
