Dukes was properly inside a stopped motor vehicle near 160th st. and Baisley Boulevard of Queens when the officers approached Dukes' vehicle with their weapons drawn, seized the vehicle, and searched Dukes' belongings without a justifiable cause. The officers charged Dukes with possession of controlled substance despite knowing that they were properly prescribed to Dukes. The officers then intentionally made false statements and continued to prosecute Dukes. Dukes was then subject to intrusive search and handcuff without her consent. Charges against Dukes was ultimately dismissed.
