Plaintiff was denied his rights to Fair Trial and Due Process and was maliciously prosecuted from the moment of his arraignment, until all adverse charges were summarily and unconditionally dismissed and pursuant to sections 160.50 or 160.60 of the New York Criminal Procedure Law on or about May 27, 2022 when the District Attorney's office declined to prosecute Plaintiff, likely due to a lack of probable cause for his arrest. Defendants approached Plaintiff's friend and accused him of a crime and began to give chase. Plaintiff began to record the defendant officers as they chased his friend and Officer Bautista reached out and smacked the phone out of his hand. Bautista then violently grabbed the Plaintiff and tackled him to the ground. Plaintiff asked why he was being arrested in which he received no response. Defendants then proceeded to conduct an illegal search of Plaintiff's person without his consent, probable cause, reasonable suspicion, valid search or arrest warrant, or any legal justification whatsoever as to the commission of unlawful conduct on the part of Plaintiff. No contraband was found. Defendants applied handcuffs tightly on the Plaintiffs wrists, in which Plaintiff complained of, but his requests to loosen them were ignored. Defendants then placed Plaintiff in a police vehicle and transported him against his will to the 30th Precinct, where he was\nfingerprinted, searched or strip-searched with questioned as to his pedigree, unlawfully interrogated detained in a dank and dirty cell for approximately\nattendant cavity inspection, photographed, without presence of counsel, and illegally (6) hours before being released from physical with a Desk Appearance Ticket. Plaintiff thereafter went to Lennox Hill Hospital where he was treated for injuries he sustained just prior due to the conduct of Defendants. As discussed above, all charges were denied to prosecute.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=gGjVSllFyUP700FD7XvgTg==","type":"complaint"}]},{"name":"Rivera, Angel vs City of New York, et al.","start_date":"2016-09-01","payout_amount":0,"disposition":"","docket":"025751/2016E","court":"Supreme Court - Bronx","officer_name":"Bautista, Ernesto E.","summary":"On June 8, 2015, defendant NYPD officer Ernesto Bautista (Shield No. 28399), along with unnamed defendant NYPD officers, approached plaintiff on a street in the Bronx and unlawfully stopped, searched, battered, handcuffed and detained plaintiff in an excessive manner, based solely on his age/race.
