Plaintiff was transported to the 70th Precinct, where he suffered an anxiety attack, lost consciousness, and was subsequently hospitalized for four days at Maimonides Hospital.\n\nAt his August 30, 2021 arraignment, Plaintiff was charged with multiple serious crimes, including robbery and possession of a firearm, despite a lack of evidence connecting him to the alleged offenses. Bail was set, and he was remanded to Rikers Island, where he endured inhumane conditions, including overcrowding, unsanitary living spaces, and exposure to violence. He was released on bail on September 1, 2021, but was required to appear in court multiple times before all charges were dismissed and sealed in his favor on September 30, 2021. Plaintiff alleges that the officers involved, including PO Adan Suazorodas, Sgt. Adnan Hussain, Det. Alexander Caballery, PO Jenson Raju, Lt. Larry Simpson, Det. Officers then removed a small knife from Plaintiff's front pocket which he had used earlier to install new lights for his car. Officers tightly handcuffed Plaintiff, bruising and cutting his arms and wrists. Although Plaintiff pled for information, Officers refused to tell him why he was being arrested, whether or not he was being arrested, or where he was being taken. Officers then transported Plaintiff to the 70th precinct where he was searched, placed into a cell and then taken to an interrogation room and questioned. After Plaintiff was processed, Officers demanded his DNA for a Desk Appearance Ticket. Officers informed Plaintiff that if he refused to comply he would be charged with obstruction because of a new law and would have to be processed again; Plaintiff complied. During his time in custody, Officers pushed Plaintiff into the cell and shoved his head against the wall. As a result of the push Plaintiff felt nauseous and requested water or something to help but Officers refused to help and Plaintiff vomited as a result. Plaintiff was forced to sit next to his vomit until he was released. While in custody, Officers provided the DA with false, misleading and incomplete information, falsely alleging that Plaintiff was engaged in criminal possession of a weapon. Plaintiff was held in custody for 9 hours after which he was released with a Desk Appearance ticket.
