As Plaintiff attempted to pull back into traffic, he was stopped by an NYPD vehicle and then approached by two Defendant NYPD officers who asked Plaintiff to exit the vehicle and then who searched the vehicle with Plaintiff's consent. No contraband was found but Plaintiff was arrested and taken to the 34th and then 43rd Precinct nonetheless. At the 43rd Precinct, Plaintiff was handcuffed to a pipe and informed that his DNA had been found at the murder scene of a man that Plaintiff knew through a mutual friend. The Defendant officers then falsely informed the Bronx DA's Office that Plaintiff had been engaged in Kidnapping and Murder. As a result, the Judge refused to set bail and Plaintiff was sent to Riker's Island. After five days, Plaintiff was released on his own recognizance when the DA failed to secure an indictment. On March 15, 2022, a jury acquitted Plaintiff of all charges concerning the murder, which actually took place in 2011.
