Plaintiff began speaking pleasantly with one of the protestors when PO Ernst approached and told Plaintiff to keep walking. Plaintiff told PO Ernst he was interested in the protestor's views and asked why he had to move along. They proceeded to go back and forth with Plaintiff saying there's no traffic on the sidewalk, he's not obstructing pedestrian traffic, and he's a citizen who had a right to hear what the protestor was saying. \n\nPO Ernest called over PO Alfieri who both insisted Plaintiff move on, falsely alleging he was blocking the sidewalk. PO Alfieri and another PO grabbed Plaintiff's arms and arrested him. They twisted Plaintiff's arms sharply in the process. Plaintiff did not resist arrest. The POs searched Plaintiff and his bag. The POs put Plaintiff into a police car, removed his wallet from his pants pocket, and told him he was being taken to central booking. POs Ernst and Beggin got in the car and took Plaintiff to a precinct where he was given a summons for disorderly conduct.
