The officers approached the car with their guns drawn, before illegally searching and seizing Plaintiff, forcibly removing him from the back of the car. Mendes, Hodos, and Skulsky slammed Plaintiff to the ground, causing him to endure substantial pain and significant physical injuries. Skulsky and Mendes applied handcuffs to Plaintiff's wrists in an excessively tight fashion. Skulsky signed a supporting deposition falsely swearing and alleging that he observed Plaintiff operating the stopped vehicle. Mendes and the arresting officer signed the criminal complaint, swearing and attesting the observations of Skulsky. The defendant officers did so with the intention of causing a prosecution against Plaintiff to begin for driving on a suspended license. Due to the officers actions', Plaintiff was deemed to have violated the conditions of his parole and was wrongfully deprived of his liberty for an additional period of approximately five months, beginning on or about August 26, 2017. On or about May 1, 2018, a trial was conducted as to the criminal charges against Plaintiff; he was acquitted of all charges. Casey and Hodos stated that he needed to shut off the grill, and plaintiff complied. Agent Casey then grabbed plaintiff's arm and put his left hand in a handcuff while Hodos grabbed his right arm and threw him against the car, cuffing both of his hands. The officers went through plaintiff's pockets, finding nothing, and shoved him in the back of a police car. Hodos then yanked plaintiff by the handcuffs further into the car. Plaintiff asked why he was being arrested, and the officers stated that he was being charged with resisting arrest. He was taken to the precinct. At the precinct, plaintiff complained of wrist pain from the earlier force and was not allowed medical attention. He was forced by Casey to sign a blank form waiving the need for medical attention. He was given a pink ticket for permitting an open flame, then taken to booking and arraignment. The matter was adjourned in contemplation of dismissal.
