The plaintiff was never in possession of any contraband found at the residence. The defendants entered the premises to confiscate a firearm but the contraband was never in plain view at the premises. Rather, the contraband was inside a shoebox behind a bar in the basement. \n\nAfter entering the premises, the defendants used their loaded firearms, limbs, and other objects to physically strike and seize the plaintiff. Further, the defendants placed handcuffs so tight on the plaintiff's wrists that they turned red. After seizing and detaining the plaintiff with excessive force, the defendants transported her to a police station in the Bronx where she was charged with several crimes and held in custody for approximately 16 days. During her time in custody at Rikers Island, the plaintiff was subject to strip searches and cavity searches multiple times. On approach, Plaintiff found the bathroom door locked. Unbenownst to Plaintiff, POs Matthew Escudero and Robert Hoey, who were outside of their geographic jurisdiction, quickly ran up behind Plaintiff, violently grabbed him, and spun him around. Plaintiff did not know POs Escudero and Hoey were POs because they were in plain clothes and did not identify themselves as POs. Plaintiff instinctively tried to protect himself against the then-unknown individuals. POs Escudero and Hoey then violently slammed Plaintiff to the ground and kicked him in the face, causing a deep laceration in Plaintiff's lip that required stitches and left him scarred. Plaintiff also injured his hands. PO Hoey sprayed pepper spray directly in Plaintiff's face, blinding Plaintiff and inflicting further pain. \n\nPOs Hoey and Escudero then handcuffed Plaintiff and forced him to sit on the ground. Plaintiff was visibly bleeding and in pain but instead of requesting medical services POs Hoey and Escudero called for additional POs. Sgt. John Doe responded and, after a brief discussion with POs Hoey and Escudero, called for an ambulance to meet them at a separate location within the POs' geographic area of employment. The ambulance met the POs at the separate location and POs thereafter led the ambulance to Yonkers. Plaintiff was taken to hospital, where POs falsely told staff Plaintiff had attempted to urinate on POs, leading to his injuries. Plaintiff was released from hospital the next morning and was never charged with having committed any crime or offense related to the incident. The plaintiffs were thereafter held in custody for about 36 hours until released. On or about July 14, 2016, the charge was dismissed.\nIn particular, Defendant P.O. Robert Thomas was the arresting officer, and he, along with Defendant his supervising sergeant, unlawfully determined that the plaintiffs were in criminal possession of contraband. Defendant P.O. Robert Hoey provided false statements based on his observations in the apartment, leading to the plaintiffs’ false arrested and maliciously prosecuted.
