At this point, Defendant Officers approached the car in two unmarked police cars and unlawfully questioned Plaintiff regarding illegal activity, despite possessing no valid reason to inquire, as no criminal activity was present or even reasonably suspected. Plaintiff was handcuffed and arrested. A criminal prosecution was initiated against Plaintiff, despite the clear lack of any probable cause, and Defendant Officers forwarded their false claims to prosecutors. The plaintiff presented his license and registration and asked Officer Hannon why he had been stopped, and Officer Hannon replied that one of the plaintiff’s tail lights was out. The plaintiff explained that his tail light was not out and asked again why he was stopped, but Officer Hannon did not answer the plaintiff’s question. He instead went to his patrol vehicle and came back after 15-20 minutes, during which he handcuffed, searched, and arrested the plaintiff for driving with a suspended license. The plaintiff was arrested without probable caused and falsely held at a cell at the 26th precinct. The plaintiff was charged with unlicensed driving and aggravated unlicensed operation of a motor vehicle in the third degree. All charges were eventually dismissed with prejudice and sealed. Officer Hannon and the NYPD further maliciously prosecuted the plaintiff by being directly and maliciously involved in the initiation and continuation of criminal proceedings against the plaintiff.
