At the time, Doseau was a 35-year-old NYPD officer but led Plaintiff to believe he was an 18-year-old college student. Doseau groomed and sexually abused Plaintiff from 2007 to 2013. Doseau routinely ordered Plaintiff to engage in child pornography by taking videos and pictures and sending them to Doseau and by performing sexual acts on video calls. In the summer of 2008, Doseau raped Plaintiff for the first time. Doseau told Plaintiff that, because Plaintiff was intersex and was born with a prostate, it was necessary for Doseau to anally rape Plaintiff. Doseau also forced Plaintiff to use an enema kit and take hormonal birth control. Doseau continued to rape and sexually abuse Plaintiff through the summer of 2013.\n\nIn August 2013, Plaintiff discovered Doseau's true age and that he was a member of the NYPD. Plaintiff then cut off contact with Doseau. On May 12, 2015, after getting counseling support, Plaintiff went to the 112th Precinct to report Doseau. Plaintiff waited hours to speak to PO Jennifer Lew, a member of the Special Victims Unit. Lew seemed hostile and expressed disbelief at Plaintiff's assertion that Doseau was an officer. After performing a database check, Lew informed the Internal Affairs Bureau (IAB). IAB officers PO Odo Penniston and PO John Montaperto arrived at the precinct after 4-5 hours, during which Plaintiff was forced to wait. Penniston and Montaperto interviewed Plaintiff in an accusatory and hostile manner. The officers then retraumatized Plaintiff by forcing them to visit scenes where the sexual abuse took place and to catalogue the pornographic images Doseau forced Plaintiff to create. The officers had Plaintiff look at the printed images in open view of other officers in the precinct.  Penniston also made lewd and misogynistic comments in Plaintiff's presence.\n\nOn August 3, 2015, Doseau was indicted and later arrested. Doseau killed himself on August 20, 2015. Plaintiff continues to suffer emotional and physical distress and has been diagnosed with Complex Post-Traumatic Stress Disorder. In the weeks after filing the summons in this case, Plaintiff has observed an increase and escalation in police presence in their neighborhood and near their place of work.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=OgJZ6/Xh5FCpLKxqzlqWbg==","type":"complaint"}]},{"name":"Andrade, Eduardo & Cortez, Barbara vs City of Ny, et al.","start_date":"2023-12-19","payout_amount":0,"disposition":"","docket":"726419/2023","court":"Supreme Court - Queens","summary":"On April 11, 2022, Plaintiffs Eduardo Andrade and Barbara Cortez were lawfully inside their home at 31-63 33rd Street in Queens when NYPD officers assaulted and battered them without cause. Officers grabbed Ms. Cortez by the wrist and shirt, causing physical injury, and attempted to drag her out of the apartment. Officer Campbell shot Mr. Andrade seven times in the testicles and thigh and then tased him in the testicles. The officers restrained him with tight handcuffs and conducted an unlawful pat-down search, despite the Plaintiffs not resisting arrest.\n\nPlaintiffs suffered serious physical injuries, requiring medical treatment and emergency surgery for Mr. Andrade. The officers denied them timely medical treatment and searched Ms. Cortez’s home, causing significant property damage. No drugs, weapons, or contraband were found. Ms. Cortez’s daughter called an ambulance, and the officers made Mr. Andrade walk to it. He was transported to Elmhurst Hospital for emergency surgery, while Ms. Cortez received medical care at Mt. Sinai Hospital. Mr. Andrade was held in police custody for about four days before being released on his own recognizance and required additional medical treatments and surgeries.
