Prior to this, DHS PO Barron Whitten had a history of harassing Plaintiff and Plaintiff had filed several complaints regarding PO Whitten's behavior. While at the deli PO Whitten approached and began to verbally abuse Plaintiff. Without provocation, PO Whitten then physically grabbed Plaintiff, punched PLaintiff in the face, dragged Plaintiff outside, threw him to the ground, and began kicking Plaintiff. Plaintiff, now bleeding from his face and injured in his body and legs, called 911 to report the attack as PO Whitten fled the scene. Other POs--including potentially PO Dennison Durgadeen, Sgt. Marle Quinones, and Sgt. Curran--responded, observed the significant injuries, and brought Plaintiff on a ride-along to identify PO Whitten. However, PO Whitten could not be found. The group then drove to the homeless shelter where Plaintiff stayed, ordered PO Whitten to report to the location, and handcuffed PO Whitten for the assault. \n\nPlaintiff's injuries were documented by EMS and the POs' report noting Plaintiff as a victim. However, in response to PO Whitten's concerns about his job, other POs falsely arrested Plaintiff for an alleged assault against PO Whitten and attempted to convince Plaintiff that if Plaintiff dropped his complaint PO Whitten would drop the assault charge. Plaintiff was handcuffed, taken to the hospital, taken to the 40th Precinct, and thereafter Central Booking. Plaintiff made it clear he did not want to drop charges against PO Whitten but after numerous hours of pressure on no sleep Plaintiff reluctantly signed a document agreeing not to pursue criminal charges against PO Whitten. Plaintiff was released after approximately 27 hours in custody after the District Attorney declined to prosecute.
