The Plaintiff observed an individual under his vehicle and the trunk to his vehicle open. The Plaintiff yelled out and the individual who was under his vehicle fled the scene. The Plaintiff approached his vehicle and observed a handgun in the trunk of his vehicle. The Plaintiff did not touch the handgun and promptly called 911 for emergency assistance. Defendant P.O. JESSI D'AMBROSIO and defendant P.O. \"JOHN DOE\"# 1-10 arrived on the scene after Plaintiff called 911. The Plaintiff explained to defendant officers what he observed, that an unknown person was under his vehicle and fled the scene, that the trunk of his vehicle was opened, and that he then discovered a handgun in the trunk of his vehicle. Plaintiff also explained to the Defendant officers that the handgun did not belong to the Plaintiff. Despite knowing that the Plaintiff contacted the police via a 911 phone call and reported the crime in progress and reported the unknown firearm to the police, defendant officers placed the Plaintiff under arrest.\n\nThe Plaintiff was held in custody for approximately one month before he was\nreleased. The Plaintiff's criminal proceedings pended approximately 1 year before the criminal charges against him were dismissed. Subsequent to the Plaintiffs arrest he suffered a heart attack. The heart attack was causally related to the stress placed on Plaintiff related to his unlawful arrest.\n\nAs a result of the foregoing, plaintiff sustained, inter alia, loss of earnings, loss of\nenjoyment of life, loss of liberty, emotional distress, mental anguish, embarrassment and humiliation, shame, indignity, damage to reputation, loss of property, loss of use and enjoyment of his property, incurred monetary costs, and deprivation of his constitutional rights. Moments before this incident, NYPD officers were apparently in the process of arresting another individual not associated with Plaintiffs. Defendant police officers had taken a female and pushed her against the trunk of Plaintiff Benoit’s vehicle as he sat in it with the motor running. Startled, Benoit’s foot hit the gas. The car did not move. In response, Defendant officer angrily ran over to the driver’s side of the vehicle, pulled out his weapon, and said, “Don’t fucking move.” A second Defendant officer then pulled Plaintiff Benoit out of his vehicle and threw him to the ground. Immediately, a number of officers proceeded to jump on Plaintiff Benoit’s back, and one officer kicked him in the face. Plaintiff Adetimirin started to video this assault with his cell phone but was grabbed by a Defendant officer and tackled to the ground. Both Plaintiffs were arrested. Plaintiff Adetimirin was held for a few hours before being given a summons charging him with Disorderly Conduct. After approximately seven hours in custody, Plaintiff Benoit was released from Central Booking with no charges being formally brought against him. Both plaintiffs sought medical attention for their injuries.
