Ukekweh reported the incident to the 47th precinct, and thereafter, one Officer Medina from the 47th precinct came to the Property to investigate with his partner. Upon investigation, Officer Medina and his partner told Ukekweh that he had a right to break the locks and go back into his office to conduct his business. Ukekweh then left to return another day with appropriate tools to break the locks and lawfully re-enter the business premises. \nOn November 21, 2017, Ukekweh went back to the 47th Precinct and told one Officer Rolye who was at the front desk that he had obtained tools with which to break into his real estate office. Officer Rolye told Ukekweh that he could go ahead and enter the premises as he planned. While Ukekweh was in front of his real estate brokerage office and lawfully attempting to gain entry, Decker, NYPD Police Officer, Shield #21941, asked why Ukekweh was attempting to remove the locks. During this interaction, Sergeant \"DOE\" showed up at the scene. Despite Ukekweh explaining the situation, Sergeant instructed DECKER to arrest Ukekweh. Defendants seized UKEKWEH and detained him without reasonable or probable cause until UKEKWEH's arraignment before the Court on November 22, 2017. Before stopping to talk to a friend, Plaintiff purchased an iPhone from an unidentified male. While talking to the friend, Plaintiff was approached by NYPD officers including Andrew Decker and other unnamed officers, who asked where he got the cell phone. Plaintiff stated that he had just purchased it, and two women who were present informed the officers that he did not steal their phone. The officers nonetheless illegally detained Plaintiff, battered him, assaulted him, and falsely arrested him. He was dragged, struck, and punched about the torso, body, and face. He was punched while being dragged around the corner to the police car, and punched in the torso/chest area while rear handcuffed during his transportation to the 47th Precinct. He complained of having trouble breathing, and lost consciousness. He was transported to Lincoln Hospital Medical Center, where he remained until he was brought to central booking and arraigned on charges for Resisting Arrest and Obstructing Governmental Administration. Officer Andrew Decker submitted a criminal complaint with false statements.
