Defendant Officer Machalek and Officers John or Jane Doe 1-10 arrived at the scene and approached the individual at the scene, and then approached and stopped Plaintiff without probable cause or reasonable suspicion. Plaintiff was accused of a criminal offense and Defendant Officers questioned Plaintiff and proceeded to seize and restrain Plaintiff without any legal justification for doing so. Plaintiff was handcuffed and restrained causing physical injury to their arms, hands, and wrists. Plaintiff was searched and no contraband was recovered on their person. Plaintiff was transported to the precinct and interrogated without counsel present for five hours. Plaintiff was detained for two days before being released from custody on March 21, 2021. Defendant Officer Machalek signed and forwarded the criminal court complaint against Plaintiff in Queens County Criminal Court which falsely accused Plaintiff of committing a criminal offense of assault.
