Both drivers exited and Plaintiff was assaulted. Plaintiff called 911 but after a significant period of time elapsed Plaintiff  traveled to the nearest precinct to implore police intervention. At the 19th Precinct Plaintiff spoke to Lt. Garcia who advised him to return to the scene of the accident and wait. When Plaintiff returned to the scene he learned POs and an ambulance had already come and gone. Plaintiff called 911 a second time and was advised to wait for the response team to return. POs John and Jane Doe responded and  Plaintiff provided his account from a car of a fellow cab driver. A PO wrongfully believed the car Plaintiff was in was Plaintiff's car and inappropriately concluded Plaintiff's account was false. Another PO stated \"We're not taking you to the hospital. We're putting you under arrest.\" Plaintiff was forcibly transported with too-tight cuffs to the 19th Precinct where he was kept for approximately 8 hours by POM Robert Anzalone, POM Martin Fogarty, Sgt. Horsham \"Doe\", Lt. Garcia, and POs John and Jane Does. Plaintiff was falsely charged with 5 counts of felony assault and was released after 2 more days in Central Booking. Plaintiff's malicious prosecution continues.
