The DA declined to prosecute Plaintiff because there was no evidence he prevented the officers from issuing the driver a summons for speeding. On March 10, 2019, Plaintiff was released from custody. POs conducted an illegal search of Plaintiff in plain view then violently contorted Plaintiff's arms behind his back so handcuffs could be applied. Plaintiff's repeated requests for the handcuffs to be loosened were ignored. Plaintiff was taken to the 47th Precinct then Central Booking. POs Jones and John or Jane Doe 1-10 caused false criminal charges to be filed against Plaintiff in order to initiate a malicious prosecution. The District Attorney's office ultimately declined to prosecute due to insufficient evidence. \n\nOn March 10, 2019 at approximately 7:00-8:00 p.m. Plaintiff went to the vicinity of the 47th Precinct to retrieve personal property. There POs John or Jane Doe 1-10 unlawfully stopped Plaintiff and other POs including PO Moreno (not a named Defendant and not previously referenced in the complaint) falsely accused him of assault and trespassing. POs then assaulted Plaintiff by punching him in the face, throwing him on the ground, and attempting to gouge Plaintiff's eye. Other officers present observed but did not intervene. POs conducted an illegal search of Plaintiff then violently contorted his arms into metal handcuffs, ignoring Plaintiff's repeated requests for the handcuffs to be loosened.
