Not realizing what he was doing, Plaintiff waved a knife at the store clerk when asking for a back of cigarettes.  When the clerk offered him cigarettes, Plaintiff placed his knife on the counter, and the clerk gave the knife to Officer Melissa Brown who was present in the store.  Plaintiff exited the store with only a plastic beverage bottle in his hand and was quickly surrounded by four police officers, all of whom aimed their firearms at him.  Plaintiff gestured with his arms for the officers to get away from him.
