Ms. Ko believed that Mrs. Sertial pulled into a parking space for which Ko had been waiting. Mrs. Sertial immediately pulled out of the parking spot and parked across the street. When Mrs. Sertial returned to enter the market Ms. Ko ran up to her and started screaming at her while holding up her cell phone. Ms. Sertial walked away from Ms. Ko as she believed the woman was mentally unsound. Minutes later the police arrived and Officer Danny Lee advised the plaintiff that she was being arrested for assault and criminal mischief. Ko or some other third party alleged that the plaintiff struck Ko's cell phone out of her hand thereby assaulting Ko and causing damage to the phone.  Officer Lee never asked for the plaintiffs version of the events, cursed, and forcibly lifted the plaintiffs limp leg into the patrol car. When the plaintiff cried out in pain, Lee told her to \"stop faking\".
