The Plaintiffs, unaware the vehicles were occupied by law enforcement, attempted to escape. Despite their incapacitated state, the Defendant officers escalated the situation with further unlawful actions, including more pepper-spray, assault and humiliation. The officers entered plaintiff's home while he was in a verbal dispute (non-physical), then forcibly restrained plaintiff, and proceeed to punch plaintiff in the head and torso, and strike him on his right ankle with a police radio.  Plaintiff was bleeding from his head and could not walk, and had to be taken to Harlem Hospital, where he was placed in a support boot, cast, and crutches, then taken back to the police precinct.  He was arraigned on multiple charges of felony assault of a police officer and misdemeanor possession of a weapon, but was released without bail.  All charges were eventually dismissed on December 9, 2013.
