Later that day, Officer Moseley-Jones went back to the 70th precinct and completed a report alleging Plaintiff had assaulted Mr. Adil Khan during the interaction in the prayer room. Officers Anthony Nevandro and Yevgeniy Belov approved the report. This interaction had been recorded by CCTV, and showed that Plaintiff had not touched any member of the group. The report initially charge non-criminal harassment, later changed to third-degree assault. On June 25, 2021 Officer Brathwaite arrived at the mosque with NYPD officers John/Jane Does 1-15, and arrested Plaintiff. They handcuffed him tightly, such that his wrists bled.
