The Plaintiffs, who were acquaintances from the \"art scene,\" arrived at the event separately, each unaware that the other was attending. There were about 200 people at the event, both inside and outside. Gun shots rang out at about 10:40 p.m. and the event attendees dispersed. including the Plaintiffs who returned to their respective apartments. Unbeknownst to the Plaintiffs at that time, Michael Steinback Jr. had been shot and killed at the event. When the police arrived, they arrested Henry Chavez, who was in possession of an illegal firearm and was covered in the victim's blood. Mr. Chavez was taken into custody, knowing he had an illegal firearm, but without knowing who shot the victim. After many hours in custody, Mr. Chavez identified the Plaintiffs as the ones responsible for the murder. After this identification, the NYPD terminated the investigation, never finding the weapon that matched the bullet or interviewing other witnesses.\n\nOn June 27, 2009, at around 6:00 p.m. in Bronx, New York, Plaintiff Rivera was taken into custody by Defendants Solis, John Doe, and Jane Doe. He was taken to the 42nd Precinct where he was questioned for over twenty hours. After answering the police's questions, Plaintiff was arrested and sent to Central Booking where he was charged with Murder in the Second Degree, Manslaughter in the First Degree, and Criminal Possession of a Weapon. At arraignment, the Plaintiff pled not guilty and was remanded without bail. Plaintiff spent the next forty-three months incarcerated at either the Vernon C. Bain Center or Rikers Island, while waiting for trial.\n\nOn June 30, 2009, around 2:45 p.m., Plaintiff Morales was taking his lunch break from work in White Plains when he was surrounded by several unmarked police cars. Several plain-clothed individuals removed him from his car and arrested him against his will. Plaintiff was handcuffed, put in a van, and taken to the 42nd Precinct in Bronx, New York, where he was taken to a room and left there for several hours handcuffed to a chair. At about 8:00 p.m. a detective came and joined the Plaintiff, and after questioning the Plaintiff, the detective informed him that he was being charged with murder. Plaintiff was then sent to Central Booking to be processed and arraigned. Plaintiff was charged with Murder in the Second Degree, Manslaughter in the First Degree, and Criminal Possession of a Weapon. At arraignment, Plaintiff Morales pled not guilty and was remanded without bail. Plaintiff spent the next forty-three months incarcerated at either the Vernon C. Bain Center or Rikers Island, while waiting for trial.
