They trailed behind his motor scooter for no  apparent reason, using an unmarked police vehicle with its lights turn on but no siren while he was riding toward the Metro Nord Station to drop off a friend. They continued to follow him even when he parked his vehicle and proceeded on foot to avoid contact with them. The police officer Georgakis approached the plaintiff from behind  while the plaintiff was on the top of a steep staircase leading from the Marion Avenue to the Elm Place. The forementioned officer Georgakis pushed him downstairs, resulting in the plaintiff’s left ankle snapping in half, with the bone sticking out of the skin. While the plaintiff laid down on the ground in agony, the police officer John Doe ran up to him, punched him in the face and then handcuffed him. The Plaintiff was taken by ambulance to the St. Barnabas hospital where he underwent  a surgery.\nAfter his release from the hospital, the plaintiff received four summonses  and he was charged with reckless driving, driving without insurance, and two counts of disorderly conduct.
