Mr. Ross declined to speak with Mr. Loria, who did not state that he wished to speak with Mr. Ross in his capacity as a police officer. When back in his vehicle, Mr. Ross was asked for his license and registration by Mr. Loria. When Mr. Ross asked why, Mr. Loria opened the car door and held Mr. Ross down. Ms. Ross exited Burger King to inquire about what was happening between the defendant and the plaintiff. When she went back inside, more NYPD officers arrived at the scene, and Mr. Ross got out of his car. After he got out of the car, two other police officers grabbed Mr. Ross and pushed him to the ground. Mr. Ross was handcuffed, arrested, and charged with resisting arrest.
