Defendants told Plaintiff to \"shut the fuck up\" when Plaintiff asked what he was doing wrong.  Defendants Shapiro and Habermehl grabbed Plaintiff by the handcuffs and dragged him towards a police car as Plaintiff's uncle and friends watched in bewilderment at the entire scenario because they knew Plaintiff had committed no offense. Defendants Shapiro and Habermehl shoved Plaintiff into the car and, a few minutes later, dragged him out of the car by pulling Plaintiff's handcuffs over his shoulders, causing him extreme pain. After Plaintiff was outside the police car, Defendants shoved Plaintiff back inside the car where he sat for more than two hours. Defendants laughed at Plaintiff's questions at the 1st Precinct as to why he was arrested, seized, and subjected to such excessive force. Defendant Christopher Lino pointed a taser at Plaintiff's groin area and told him to \"shut the fuck up\" in response to Plaintiff asking to speak to a supervisor. Defendant Lino kept shouting that if Plaintiff \"did not shut the fuck up\" he was \"going to taze\" plaintiff's genitals. Plaintiff was placed in a jail cell for 4-5 hours before a supervisor told Plaintiff that he was sorry for what had happened. Defendant Shapiro gave Plaintiff a ticket for disorderly conduct, as Plaintiff was told he had to be given a ticket for something to justify the arrest and seizure. Defendant Shapiro assured Plaintiff that he had no intentions of following through with the complaint, but Plaintiff had to go to court 6-7 times before the case was dismissed because Defendant Shapiro refused to show up or withdraw the charges against Plaintiff.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.459996/gov.uscourts.nysd.459996.4.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/13347616/diakite-v-the-city-of-new-york/"}],"id":"7V3M","url":"https://www.50-a.org/officer/7V3M"}
