Plaintiff S.B., who was fourteen-years-old at the time, was asleep, wearing only underwear, when Defendant Officers barged in and threw her to the floor.  Despite that Plaintiffs were not found in possession of any contraband and had not committed any crimes or offenses, Defendant Officers placed them under arrest and then proceeded to ransack Plaintiffs’ apartment, destroying their personal property. Plaintiffs were taken to the 41st precinct. After approximately 13 hours in custody, plaintiff S.B. was released. Plaintiffs Luis Martinez and Cherise Martinez were taken to central booking and Defendant Officers, including Fidanza, Balicki, Edouard, Rivera and Pasquale, fabricated police paperwork and falsely charged Plaintiffs with possession of contraband.
