Plaintiff was charged with narcotics related offenses and was incarcerated for two weeks prior to posting bail. Plaintiff did not possess any controlled substances constructively or otherwise. At approximately 8AM, plaintiff R.G. who was 15 years old, was getting dressed for school when she noticed several police officer kicking in the front door of her home. Plaintiff Anthony Newsome also heard the commotion and walked toward the door. The officers forced their way inside and threw Mr. Newsome to the ground. The officers had their weapons drawn including one firearm pointed directly at Mr. Newsome's back. R.G. who was only partially clothed, was handcuffed and taken to the hallway outside. Both plaintiff's were detained in the hallway while the officers ransacked the apartment. No illegal substances were found on the plaintiffs, near the plaintiffs, in the plaintiff's rooms or in the common areas of the apartment. Nevertheless, they were transported in handcuffs to the 73rd precinct. Inside the precinct, R.G. was searched by a female officer and handcuffed to a bar in a back room. Mr. Newsome was also searched and then placed in a cell with several other individuals. Approximately twelve hours later, Mr. Newsome was released with a Desk Appearance Ticket and R.G. was permitted to leave with him. When they returned to their home they had to gain entry by climbing through a window because Police officers had placed a padlock on the front door and claimed to have lost the key. Mr. Newsome was required to make a court appearance and wait several months before he was informed that the Kings County District Attorneys' Office declined to prosecute. While searching her apartment, defendant officers unlawfully handcuffed Ms. Johnson's two children. Plaintiff tried calling 911 to complain that her children were being handcuffed, but an officer seized her phone and told the operator that police were already at the scene. The officers conducted an unlawful search of plaintiff's phone and took photos of the contents of her phone. No contraband was found in the apartment, and the police ultimately uncuffed plaintiff's children and left without making any arrests. \n\nOn September 20, 2011, plaintiff Wayne Millington contacted the NYPD and inquired whether the NYPD was seeking to arrest him, which he was told that he was not wanted by the NYPD. However, on September 27, 2011, plaintiff Millington was arrested without probable cause.
