NYPD Officers, including Edward Najarro and Jovanni Santana, approached Mr. Merchant in his vehicle and signaled him to park in a different spot, and he complied. The Officers then demanded identification without any reason for doing so. When Mr. Merchant asked why they approached him and to speak to a supervisor, the Officers ignored him. They threatened to break the front window, surrounded the vehicle, and ordered him to step out of the vehicle. Ms. Classen was notified by a bystander that police had surrounded the vehicle and left the store to ask why they had done so. Defendants claimed it was because Mr. Merchant had double-parked. Ms. Classen entered the vehicle to comfort her son, who had become emotionally distressed. Mr. Merchant provided ID and exited the vehicle upon further request. When he did, Officers slammed him against the vehicle, contorted his arms, and applied tight handcuffs. The Officers then accused Ms. Classen of a criminal offense, opened the door to the vehicle and pulled her out, contorted her arms, and applied tight handcuffs. The Officers handed Ms. Classen's son to a total stranger who was a minor, and removed Plaintiffs to the precinct. Plaintiffs were interrogated without counsel present and without being read their Miranda rights. Defendants fabricated evidence and forwarded charges against Plaintiffs which they knew were false. Plaintiffs were released with Desk Appearance Tickets and/or Summonses.
