Plaintiff has a known history of being disliked by Officer Cheikhali. As plaintiff attempted to leave the residence, Officer Cheikhali became verbally aggressive and gave an unlawful police order that plaintiff was not allowed to leave the premises. Officer Cheikhali made false accusations against plaintiff, accusing him of trespassing and fabricating outstanding warrants. Officer Cheikhali became physically aggressive and threatening towards plaintiff's attempt to leave the premises, while requesting additional police officers to the scene. Officer Cheikhali initiated an unlawful chase toward plaintiff after attempting to leave, causing him to sustain bilateral, open ankle fractures. \n\nUpon the arrival of additional NYPD officers, plaintiff's complaint of severe injuries were repeatedly ignored, and he was initially denied transport to the ER by ambulance. Defendant police officers repeatedly inflicted physical harm and discomfort to the plaintiff by roughly moving him, twisting his ankles and flipping him over despite his injuries, in order to place handcuffs and initiate an arrest. Plaintiff was falsely arrested by Defendant Police Officer Lauran Watson, supervised by Defendant Sergeant Christopher Aitola. At no time during the foregoing incidents did any of the defendant police officers intervene, or come to the aid of Plaintiff.\n\nPlaintiff was transported by ambulance to Kings County Hospital for medical treatment, and remained under arrest until May 21, 2023. The defendant police officers falsely re-arrested Plaintiff on or about May 22, 2013 on assault charges. Defendants came through the front door, screaming, and demanded that Plaintiff come with them. When Plaintiff asked what was going on, Defendants maced him, and he fell to the ground. Defendants twisted Plaintiff’s hand and arm, injuring him, including the fifth metacarpal on his right hand. Notwithstanding that Mr. Sandiford was already in cuffs, Defendants continued to assault him, including by macing him again, punching him, and striking him with a police radio. Defendants arrested Mr. Sandiford without probable cause or reasonable suspicion and took him to a police precinct. At the precinct, the officers falsely informed employees of the Kings County District Attorney’s Office that they had observed Plaintiff obstruct governmental administration resisting arrest, and prepared false paperwork, including an arrest report. At the precinct, Plaintiff requested medical attention but was denied the same. After approximately three hours, Defendants contacted EMS, and Plaintiff was taken to Beth Israel Medical Center for treatment. Plaintiff was eventually returned to the precinct and then taken to Brooklyn Central Booking. Plaintiff was arraigned in Kings County Criminal Court, where he was released on his own recognizance after spending approximately 24 hours in custody.
