Plaintiff was deprived of his constitutional, common law and statutory rights when the individual defendants unlawfully stopped, detained, assaulted, battered, subjected to excessive force, passed along false accusations to prosecuting attorneys and engaged in the malicious prosecution of Plaintiff. On the above mentioned date, Plaintiff was walking from his apartment on on Mermaid Avenue to the 24 hour deli on his block. A stranger asked Plaintiff for a cigarette, and Plaintiff started to reply. All of the sudden, five or six defendant police officers approached him and immediately bean to search him.\npockets. The defendant officers did not say anything to Plaintiff before going into his pockets. Defendant officers then picked Plaintiff up bodily and slammed him onto the sidewalk, causing him bruising, substantial pain and injuries to his body and both his shoulders. Defendant officers then handcuffed Plaintiff and searched his person again. Plaintiff was thrown into a vehicle and transported to the 60th Precinct. Despite Plaintiff’s pleas for information, none of his assailants told him that he was being arrested, what he was being arrested for, or where he was being taken. Plaintiff was photographed, searched again, and fingerprinted at the 60th Precinct. \nPlaintiff remained at the 60th Precinct for approximately 12 hours before being transported to Central Bookings. Once he arrived at Central Bookings, Plaintiff was again searched and had his retinas scanned. While Plaintiff was in custody, the defendant police officers provided the Kings County District Attorney’s Office with the false, misleading and/or incomplete information that Plaintiff committed a crime. Specifically, the defendant police officers falsely stated to the Kings County District Attorney’s Office that Plaintiff was engaged in Criminal Possession of a Weapon in the Second Degree and other related charges. Based on defendant officers’ false allegations, Plaintiff was ordered held on bail at arraignment. Plaintiff managed to scrape together the bail money approximately 5 days later and was released on October 3, 2020, after approximately 6 days in custody. Plaintiff was forced to return to court numerous times during the pendency of his criminal case. Plaintiff was fired from his job at a deli due to his arrest and open case. Plaintiff was making approximately $500 each week at his job at the deli. Plaintiff was unable to find new employment until mid-November, 2021.
