Plaintiff questioned the officers, who then surrounded him.  Defendant Officer Richard Fazio shouted profanities at him.  Defendant Officer Kelly Rios then pepper sprayed Plaintiff in the face.  Other officers grabbed Plaintiff and took him to the ground while others struck Plaintiff’s face and head.  While being transported to Transit District 1, Defendant Fazio made derogatory statements about Plaintiff's wife, which promoted Plaintiff to spit in the Defendant Fazio’s face.  Defendant Fazio had the car stopped, removed Plaintiff, and physically assaulted him, including choking him.   The Defendant Officers prepared false statements about assault and resisting arrest.  After his release, Plaintiff was treated for a fractured eye socket and other severe head injuries.  Plaintiff was unable to work for many weeks, delaying his educational program by a year.
