Plaintiff immediately got out of bed and left her apartment, heading out to the front of the building.  Upon exiting her building, Plaintiff saw that her son was   approximately two feet from the entrance of her building and surrounded by approximately nine defendant NYPD Officers who were punching, kicking, choking, and tasing him.  Plaintiff approached the NYPD Officers, informed them that they were assaulting was her son, and yelled at them to stop. One of the defendant NYPD Officer's pushed the Plaintiff and told her to “get the fuck back.” Plaintiff continued to plead with the defendant NYPD Officers to stop assaulting her son, exclaiming that he was not resisting arrest as he was lying prone on the ground, and was unarmed. In response, a different defendant NYPD officer, pushed the Plaintiff to the ground, put a knee on her back and pinned her to the ground, which caused her to have extreme difficulty breathing for approximately five minutes. Plaintiff also suffered cuts, bruises, and bleeding to her hands and arms as a result. The Plaintiff was then handcuffed, placed her under arrest and searched before she brought to the 114th Precinct where she was detained for approximately 16 hours.  Plaintiff was then brought to Queens Central Booking for approximately 21 more hours.  Defendants told the Queens County District Attorney’s Office that Plaintiff had committed the crimes of Obstructing Governmental Administration in the Second Degree and Resisting Arrest. At her arraignment on January 28, 2021, plaintiff was released on her own recognizance. Plaintiff denied then, as she does now, that she committed any of the accused acts and attended approximately two additional court appearances before her case was dismissed and sealed on May 14, 2021.\nPlaintiff continued to feel pain in her left wrist as a result of the tight handcuffs on her wrist and sought medical attention on January 29, 2021, after she was released from custody at Mount Sinai Queens Hospital.   At the hospital X-rays were taken, and plaintiff was diagnosed with a sprained ligament, and had her wrist wrapped in a bandage.  Plaintiff continues to experience numbness in three fingers on her left hand as a result of her injury and was also concerned  that the close interactions with defendant NYPD Officers put her at risk of contracting Covid-19.
