The NYC Criminal Court found on January 27, 2014, that the entry lacked probable cause, a warrant, or consent, and no emergency justified the entry, nor did the officers conduct any investigation prior to entry. When the defendant officers entered the residence, the paraplegic plaintiff was sitting in her wheelchair in the living room. Plaintiff communicated via writing and hand gesture her desire for the officers to leave, but the officers searched plaintiff's purse and arrested plaintiff for gun possession, handcuffing the plaintiff. Plaintiff asserts she has never owned a gun, but the defendant officers claimed she drew a gun and exhibited aggressive behavior. Plaintiff was handcuffed at the Metropolitan Hospital Center for 17 hours from December 20 to December 21, with her right hand cuffed to a side rail and her feet cuffed to each other despite plaintiff's paraplegic status.
