Mr. Rivas exited his apartment building to observe a car accident that had taken place between two vehicles. Mr. Rivas observed two police vehicles, multiple police officers and approximately twenty civilians surrounding the accident. Mr. Rivas, no longer interested in rubbernecking, was on his way back into his building when four Defendant officers followed him into the lobby of his building and forcefully pushed him, against the wall. The Defendant Officers searched Mr. Rivas without probable cause to do so. At no point did Mr. Rivas resist arrest or fail to comply with the commands of the Defendant officers.\n\nThe Defendant officers unlawfully handcuffed Mr. Rivas, placed him in a patrol\ncar, and transported him to the 25th Police Precinct. While in the patrol car, Mr. Rivas requested medical attention for his hand and back but was instructed by Defendant Officers that he had to wait until they arrived at the 25th Police Precinct. He arrived at the 25th Precinct at approximately 6:30 p.m., where he was placed in a holding cell, searched, fingerprinted and photographed. While Mr. Rivas was at the 25th Police Precinct he made another request for medical attention. The Defendant Officers gave him Tylenol. Mr. Rivas spent approximately 6 hours in unlawful police custody. He was given a Desk Appearance Ticket and released from the 25th Police Precinct at approximately midnight. Following his release, Mr. Rivas sought emergency medical treatment at Northwell health for the injuries sustained while in custody. He was informed that he had a fractured right wrist and was treated with a soft cast splint that he had to wear for approximately six (6) weeks.
