Defendant Officers ignored Plaintiff's request to be taken to the hospital. Plaintiff was then transferred to Brooklyn Central Booking and remained there for approximately 12 hours. While at Central Booking, Defendant Officers informed Plaintiff that he needed to be strip searched. Plaintiff objected to no avail. Defendant Officers forced Plaintiff to take off his pants and then manually inspected his groin and private parts with their hands; no contraband was found. The Defendants—NYPD Police Officers Daniel Mizvesky, Damany Ferril, John, or Jane Doe 1-10—abruptly entered Plaintiff’s mother’s apartment with consent, a search warrant, legal authority, or any indication that Plaintiff did any illegal acts. After entering the apartment, the Defendants woke Plaintiff up by shining bright lights on his face and placing their shields and weapons close to Plaintiff’s body. Without any legal justification or probable cause, the Defendants grabbed the plaintiff’s body, and extremities, violently contorted the plaintiff’s arms behind his back, and then affixed metal handcuffs to his wrists in an excessively tight fashion while he was dressed in boxers. The Defendants then arrested the Plaintiff despite there being no probable cause, search warrant, arrest warrant, legal authority, or indication that the Plaintiff committed any crimes or had any violation of the law. Though the Plaintiff requested that the Defendants loosen his handcuffs, the Defendants ignored the Plaintiff’s pleas and then sadistically and intentionally squeezed the handcuffs further to inflict more pain on the Plaintiff. Plaintiff then suffered contusions, swelling, and loss of feeling in his wrists, hands, and arms. \n\nAfter moving the Plaintiff from the bedroom to the living room of his mother’s apartment, the Defendants illegally interrogated the Plaintiff, which led the Plaintiff to ask Defendants for a search warrant. Defendants then purported to the Plaintiff a piece of paper they stated was a valid search warrant but would not show the Plaintiff the paper. Defendants then proceeded to illegally search and seize the apartment but could not find anything illegal. Defendants then transported the Plaintiff against his will to the 79th precinct where he was criminally processed, invasively searched, subjected to illegal interrogation tactics, and maliciously prosecuted by the Defendants who gave false information to the District Attorney's office to charge the Plaintiff. Plaintiff then remained in prison until September 3, 2020, at noon and was charged with six different crimes despite a lack of probable cause or any evidence indicating he committed a crime. Ultimately, Plaintiff’s charges were dismissed on November 5, 2020. Officers pointed their guns at plaintiff Edjar Joel Suren, who was 17, arrested him and placed him in handcuffs. Officers then grabbed plaintiff Lucia Santigao, 65, off her bed and handcuffed her. Officers then grabbed plaintiff Ismael Suren, Jr. and handcuffed him as well. Officers asked where the \"guns and drugs\" were, which plaintiffs denied having. They then asked where Nelson Santiago was, and plaintiff Lucia stated he did not live with her. Officers had her call Nelson and he came to the house, where plaintiff Nelson was then arrested and searched. Family members Edgardo Suren and Ismaal Joel Suren went to the residence and they too were arrested and asked about guns and drugs. \nOfficers searched the entire apartment without a warrant. Officers found a vial which contained Ismael Suren Jr's father's ashes but officers accused the plaintiffs of having heroin. plaintiffs were then all taken to the precinct, where they were detained for many hours. All charges against plaintiffs were ultimately dismissed.
