Instead of providing plaintiff with medical assistance, defendant officers placed plaintiff in handcuffs and began to search his person and the surrounding area. The Defendants assaulted Mr. Feliz by intentionally discharging a total of ten (10) rounds from their service firearms at Mr. Feliz during their interaction with him. None of the shots discharged at Mr. Feliz by the defendants were justified, nor were these shots discharged at him at a time when he posed any imminent or serious threat of injury or harm to any officer or other person.\n\nMr. Feliz ultimately fell into the Bronx River and the defendants immediately placed him in handcuffs and began to search his person and the surrounding area instead of providing the emergent and immediate medical assistance that he needed at the time. This delay, and the defendants’ failure to prioritize and obtain the emergent and immediate life-saving medical attention plaintiff-decedent needed, evidenced a deliberate indifference to plaintiff-decedent’s medical needs.
