At that point, Plaintiff was struck in the face by Defendant VERDEJO, allegedly because Plaintiff began \"flailing his arms.\" Upon being struck, Plaintiff lost consciousness and fell to the ground. Plaintiff, bleeding profusely from his face, was transported to Harlem Hospital where he regained consciousness to find himself handcuffed to the hospital bed. Plaintiff was thereafter taken to Manhattan Central Booking where he was charged with Resisting Arrest, False Personation, and Consumption of Alcohol in a Public Place. Plaintiff was arraigned the same day (May 3).
