When asked why he was being arrested, Plaintiff was not given a reason. Defendant P.O. Hepworth told Plaintiff to stand next to the police car while he was handcuffed. As plaintiff was standing there, a man sitting in the back seat of the car reached out and punched Plaintiff twice. Plaintiff immediately complained and asked to file charges against the individual who had just struck him. Defendants laughed and ignored the complaint. One officer told Plaintiff the man in the car was accusing him of assault. Plaintiff denied this and people who had just been with him corroborated this. Eventually, Sgt. Helton arrived on the scene and approved the arrest.  Plaintiff was taken by Defendants Hepworth and Gaiquinto to the 61st precinct of the NYPD, where he was processed and placed in a cell where he remained for about fourteen hours. From there, he was transferred to Central Booking in BK, where he remained for another ten hours.
