Plaintiff went outside to speak with New York Sanitation Enforcement Agent Ilva Harrigan and Harrigan said that she looked in the bag and saw that some of the contents were from Plaintiff’s optical store, she told Plaintiff that the bag should not have been left on the street during the day. Plaintiff explained that the bag was not his and that he put his business’ garbage bags out for collection the night before. He then returned to his business. Shortly thereafter, Harrigan posted a Notice of Violation and Hearing on Plaintiff’s store door, which falsely stated that she saw a trash bag on the public sidewalk in front of the Plaintiff’s store more than one hour before the store’s closing time. \n\nPlaintiff approached Harrigan and asked her to amend it to reflect she observed the trash bag in front of the neighboring store. Harrigan was in her car and refused to speak with the Plaintiff, so he called 911. NYPD Officers Liampachara and Rodriguez responded and Plaintiff informed them of the false ticket situation. The officers told him there was nothing they could do and Plaintiff returned to his store. Later, he was asked to go back outside and encountered NYPD Sergeant Semioli, who asked why Plaintiff stood by Harrigan’s car. Plaintiff tried to explain the false ticket situation, but Semioli said he did not want to hear about the ticket. Semioli then spoke with Harrigan and another sanitation agent. He asked Harrigan whether Plaintiff threatened or touched her, and Harrigan responded “no” to both questions. Plaintiff heard Semioli say “I cannot arrest him,” but after Semioli spoke further with the sanitation officers, he instructed Officer Liampachara and Rodriguez to place Plaintiff in handcuffs and put him in a police car. Plaintiff was brought to the precinct photographed, fingerprinted, and searched, and his money was vouchered. Early on July 10, 2014, he was abruptly released from custody. It took months for the Plaintiff to recover his money.
