The defendants unlawfully questioned plaintiff about illegal activity without a reason and they physically restrained and removed Plaintiff by handcuffing him and putting him in substantial pain. The Defendants entered the car unlawfully and fabricated observations such as that Plaintiff possessed a forged license plate in order to justify the illegal search and seizure of Plaintiff. Defendants falsely arrested and imprisoned Plaintiff without probable cause. Defendants forcibly took Plaintiff to the 81st precinct, made Plaintiff fear for his physical well being and put him in apprehension of immediate harmful or offensive touching, and subjected Plaintiff to immediate harmful or offensive touching and battered him without consent. At the precinct the defendants criminally processed the plaintiff. Defendants had no probable cause and illegally interrogated Plaintiff and threatened him with a protracted criminal prosecution and imprisonment if he did not give false evidence against Defendant's intended target and suspect. Defendants also sent fabricated evidence to prosecutors and they suppressed exculpatory evidence from prosecutors such as that the possession of a forged license plate was found pursuant to an unlawful search of Plaintiff even though the defendants knew that Plaintiff did not commit any crimes. Defendants tried to have a criminal prosecution against the plaintiff in order to use Plaintiff's arrest to lure their true target and to get additional benefits and overtime compensation. While walking down the sidewalk after legally parking his brand new Mercedes Benz, plaintiff noticed Defendant NYPD officers following him, at which time plaintiff began to record the officers on his phone. Plaintiff walked back to where his vehicle was parked when Officer Yuriy Demchenko arrived with his partner in his vehicle. Officer Demchenko asked for plaintiff's ID, refused to inform him why he was being stopped and questioned, and grabbed the plaintiff before arresting him. Plaintiff was not informed as to why he was being arrested. Plaintiff did not commit a crime and the officers had no legal justification for stopping and detaining plaintiff. The officers then performed a complete and unlawful search of his Mercedes; at one point they even ripped the seats open. The officers did not recover any contraband. Plaintiff requested for his handcuffs to be loosened on multiple occasions, as his hands were going numb, but the officers refused. Plaintiff suffered bleeding and received marks on his wrists from the excessively tight handcuffs. Plaintiff was denied medical treatment for his bleeding wrists upon his request. After being transported to the 75th Precinct and Kings County Central Bookings, plaintiff finally received medical treatment for lacerations on his wrists, tightening in his chest, headache, and was also given a psychological evaluation due to the high stress and anxiety of the events inflicted by the Defendant officers. The Defendant police officers provided the District Attorney's Office with false, misleading and/or incomplete information that plaintiff committed a crime. Plaintiff was held in custody for approximately 40 hours before being arraigned. They had a warrant based on a tip from a confidential informant that crack cocaine had been sold by Ms. McClain's brother in the apartment. Ms. McClain's brother did not live in the apartment, nor did he ever live there or have keys, and only visited every few weeks. Ms. McClain, wearing only undergarments at the time, was pushed into a chair and handcuffed with excessive tightness. Her mother and six-year-old son were in another part of the apartment, told to \"get the fuck down on the floor\" at gunpoint, and Ms. McClain was not allowed to see them. Their requests to use the bathroom were denied. The apartment was ransacked and property damaged. After about a half hour, Ms. McClain requested proper clothing; and despite her wishes for her mother to assist in putting them on, a male officer dressed her. Her requests to loosen the handcuffs were ignored, causing swelling the day after. Ms. McClain was brought to the precinct against her will, and her mother and son were told to vacate the apartment for them to search it further. When they returned the door was off its hinges and the apartment left completely unsecured for anyone to enter. At the precinct, Ms. McClain was searched by a female officer in an obtrusive manner. She was held in a cell in the precinct the entire day and transferred to Booking overnight where she was held overnight until arraignment. \n\nOfficer Demchenko was the deponent of the criminal complaint against Ms. McClain which falsely alleged that the officers found drugs in the apartment and that Ms. McClain had admitted to smoking weed. Officer Allen falsely averred in an Affidavit of Inventory of Property Taken that various narcotics in NYPD custody were recovered via the search.
