Plaintiff's sister briefly walked into the ocean to remove sand, after which point defendant-NYPD Officers approached the sister and ordered her leave the beach for rules violations. Plaintiff then witnessed defendant-NYPD officers, including defendant Smit Feliz (Shield No. 00684), slapping, pushing, and physically striking his sister. Plaintiff approached the defendant, at which point defendant-Officer Feliz struck the plaintiff, before returning to assault plaintiff's sister. After plaintiff's repeated pleas, defendant-Officer Feliz returned to striking and battering the plaintiff. Soon thereafter, defendant-NYPD officers, including Sergeant Ricardo Wyman and Sergeant Genao, electrocuted plaintiff with a Taser Gun in the upper chest. While on the ground, the defendants continued to strike, push, and punch plaintiff.\n\nSubsequently, defendants handcuffed and arrested plaintiff and called an ambulance. Plaintiff was handcuffed and shackled to a gurney and transported to Jacobi Hospital, where he remained handcuffed and shackled during his medical examination and treatment. Plaintiff was transferred and processed to the 45th Precinct. During this time, the defendant-NYPD officers falsely communicated information to substantiate and maintain criminal proceedings against the plaintiff. On June 30, 2017, plaintiff was arraigned in Bronx County Criminal Court.
