Plaintiff Gaines was arraigned after her arrest and thereafter prosecuted with committing a crime. The defendants did not have a warrant.  Her photographs and fingerprints were taken and she was held on various criminal charges at various police stations, correctional facilities and the Courthouse in New York. Plaintiff Gaines remained incarcerated for over 24 hours, but all charges against her were dismissed.  She sustained physical and emotional pain and injuries as a result of this incident.
