On the bus, where they overheard a man known as \"Black\" talking about taking another person's cell phone. Plaintiff, his friend, and another woman on the bus told Black to return the phone, which Black refused to do. Plaintiff grabbed the phone out of Black's hands. The phone rang, and Plaintiff answered--the caller indicated that the phone's owner was at Housing Works. Plaintiff said he would bring the phone there, which he did. He delivered the phone to the owner and explained what happened. In response, the owner was convinced that Plaintiff stole the phone, so she called the police. Intending to explain his innocence to the police, Plaintiff waited for them to arrive. \nWhen PO Schemmel and a group of unknown POs arrived, they listened to the owner's false story about how Plaintiff stole her phone. Nowhere in the story did the owner indicate that she observed Plaintiff take her phone. Plaintiff then explained his side of the story, but the POs arrested him and charged him with petty theft, despite conducting no investigation, checking surveillance footage, or questioning witnesses who could have informed them that the owner's accusations were false. Plaintiff was transported to the precinct. On November 12, 2021, Plaintiff appeared in in Criminal Court, where he accepted an Adjournment in Contemplation of Dismissal.
