The peaceful protest was organized after the deaths of Breonna Taylor and George Floyd in May 2020. Plaintiffs identified themselves as lawmakers to police officials before and during the protests. Shortly before 8 AM, the defendant NYPD officers broadcast a message to the protesters, telling them to disperse, despite having no legal basis for this order. Plaintiffs attempted to comply with these commands, but the NYPD officers \"kettled\" them in place, leaving them with nowhere to go.\n\nDefendant officers including Defendand Ciota then began to use their bicycles to assault Plaintiffs and other protestors, ramming their legs, abdomen, and pelvic area. The officers, including defendants Clinton, Perez, Kovalik, Bemudez, and Ciota then sprayed plaintiffs with pepper spray, blinding plaintiffs and knocking Plaintiff Richardson to the ground. No defendants attempted to give medical assistance to plaintiff Richardson. Meanwhile, defendants Taylor and Calderon arrested plaintiff Myrie without probable cause and refused to offer him medical assistance. Defendant officers Kovalik, Ciota, Bermudez, Ventrella, Olfano, and Kerr failed to intervene in the unlawful conduct against both plaintiffs. Plaintiff Myrie was eventually identified as an elected official and was released from custody. The plaintiffs then left the scene of the protest. Plaintiff bought a cigarette from a local bodega and began smoking outside its premises. While smoking, he was approached by Defendant police officers who asked for his identification, which he provided.  The Plaintiff did not commit any crime or acted suspiciously, however the officers asked him to place his hands behind his back. When plaintiff asked why,  the officers forcibly handcuffed him, and threw him into the police vehicle causing physical injury. The plaintiff was then illegally searched however the officers did not find anything illegal. Thenafter, plaintiff was then taken to the 41st Precinct, fingerprinted, photographed, and detained without being informed of the charges. Plaintiff  complained about the tight handcuffs and pain, however no medical treatment was provided. The officers also provided the District Attorney's Office with the\nfalse, misleading and/or incomplete information that plaintiff committed a crime. The District Attorney's Office declined to prosecute, and the Plaintiff was released without charges. Plaintiff sustained a permanent wrist scar from the handcuffs and suffered physical, psychological, and emotional trauma due to the officers' actions.
