Gunina protested and asked P.O.s why they were manhandling her friend, she was ignored and they jumped onto Gunina’s friend in furtherance of their aim to handcuff her. Gunina began to use her cell phone to record the use of force by Kats and Assaidi on her friend. Kats and Assaidi, upon seeing they were being recorded, grabbed Gunina and wrestled her to the ground. Beach goers around the scene began to approach and attempt to calm the situation upon seeing the excessive force being used. Kats and Assaidi tightly cuffed Gunina to prevent the use of her hands. Kats and Assaidi took Gunina’s phone and began to try and unlock it to delete the recorded video. Assaidi then ordered Gunina to unlock the phone under threat of both physical and legal harm. Gunina unlocked the phone and Assaidi deleted the video. \n\nGunina was taken to a local precinct for processing and given two summons, one for open container and one for disorderly conduct. Gunina never had any alcohol with her, nor did she resist arrest. Defendant John Doe 1, the supervising sergeant ratified and approved the summons. At the light, officers Acierno and Assaidi pulled up behind plaintiff and turned their lights and siren on. Plaintiff immediately pulled over to the curb. Officers then approached and asked for his license. Plaintiff asked if he had run a red light and Acierno told him he was stopped because he was wearing a bandana that covered the lower half of his face and because his music was too loud. The covering on his face was used during work while putting down asphalt. \nPlaintiff gave his license and officers returned and told him there was a warrant for his arrest. Plaintiff exited his vehicle and told officers he had appeared in court three days prior and the prosecution had been dismissed. Officer Acierno still grabbed his arm, twisted it and tightly handcuffed plaintiff.
