Bernard had assaulted her with a basketball earlier in the week. A few hours later, Plaintiff Mr. Smith arrived home and was approached by K. Bernard, who verbally attacked Plaintiffs and then physically attacked Mr. Smith. Plaintiffs' daughter called 911 a second time, but when Defendant Guevara and their partner arrived at the scene, Defendants S. Bernard and K. Bernard lied about what happened. Despite Plaintiffs being lawful complaining victims and witnesses informing the NYPD that they were indeed the victims, Plaintiffs were arrested. The Officers targeted Plaintiffs because of their race. Officer Guevara and their partner violently contorted Plaintiffs' arms and applied handcuffs that were too tight. The Officers then illegally searched Plaintiffs and brought them to the precinct. Officer Guevara and other Officers fabricated false evidence and committed fraud and perjury when forwarding the case to prosecutors. This followed after Plaintiff Mrs. Smith was verbally attacked by her neighbor who used inappropriate profane language. Defendants conducted a police investigation, generated a complaint report, but failed to arrest Plaintiff Mrs. Smith’s neighbor for committing a criminal offense, then left the vicinity. Plaintiffs’ neighbor, 3 hours later, illegally approached Plaintiff Mr. Smith and threatened with bodily harm, then began to physically batter and assault Plaintiff Mr. Smith by punching him about his head and body with closed hardened fists. Plaintiff Mr. Smith was forced to use self-defense against his neighbor. Defendant NYPD officers returned to the scene in response to a 911 call from Plaintiffs Mrs. Smith, where Plaintiffs’ neighbors lied to NYPD defendants. ON the basis of said lies, Defendant NYPD officers proceeded to violently apply metal handcuffs to Plaintiffs, disregarding Plaintiffs pleas of discomfort, and proceeded to illegally search them, recovering no contraband. Plaintiffs were unlawfully targeted due solely to their statuses as Hispanic, Latino, or African American.\n\nDefendants, including GUEVARA and JOHN OR JANE DOE 1-10, then placed Plaintiffs in a police vehicle and transported them against their will to the 47th Precinct where they were fingerprinted, photographed, questioned as to their pedigree, searched or strip-searched, interrogated without presence of counsel or the reading of their Miranda rights, and illegally detained in a dank and dirty cell for approximately twelve (12) hours before being transported\nagainst their will to Central Bookings, where Plaintiffs were again fingerprinted, photographed, searched, questioned as to their pedigree, and illegally detained throughout various dank and dirty cells for approximately twelve (12) hours before being released from physical custody on or about\nAugust 13, 2022 after their respective arraignments. As a result Plaintiffs were caused to suffered substantial pain, extreme shock, fear of bodily harm, and severe mental anguish.
