According to testimony from Santiago , during this time plaintiffs were sitting in the vehicle with their hands in their laps\" Plaintiffs were dragged out of the vehicle and slammed to the ground and beaten . At no time during this incident did plaintiffs commit any crime.  Despite these facts plaintiffs were arrested and charged with Criminal Possession of a Weapon in the Second Degree.  Plaintiffs both spent over 24 hours in custody .
